Child's Health Insurance through military father...?

If my son has had his health insurance through his father's employer (military tricare) since he was born, and we have not yet got a divorce, is there any way I can request that the child stays on that insurance? Or does the father have to have custody of the child in order for him to have that insurance? Just to avoid hassles make sure it is in the divorce decree that he will provide the child with medical/dental. You use the word "my son". So here's how it works: A child of a military servicemember retains tricare through the child's life and now with the new reform in healthcare which will probably be voted down it is enteded to the end of college under a new modified tricare program for college students. If the child is a step child of a military servicemember, then the child loses tricare eligibility when the divorce is finalized.



Tricare is maintained for the spouse and children of the spouse until the divorce is finalized. Eligibility can be extended to complete a care process, for example, surgery is completed one day before divorce, and 3 weeks later a follow up is needed to remove sutures, that can be done. That's why the big military hospitals have an open gate policy, requiring only drivers licenses at most.



The servicemember does not have to retain custody of the child to retain tricare benefits. BUt if the servicemember loses loses all parental rights, such as in an adoption then yes, the dependents would lose tricare benefits then.Child's Health Insurance through military father...?you can insist that your son remains on tricare and with the dental............father does NOT have to have custody, he is either wrong or blowing smoke, either way NOT true.



Does not matter the branch Tricare covers all of them, so the rules stay the same.



He can ask but point out to the judge it comes out his pay directly before it comes into the bank and if he insists that you pay the small amount then there is a good chance that it will mess things about with tricare...If the judge rules you pay, then you pay but in general the active duty member is made to carry the cost.......it is NOT that much and a LOT less than any other insurance premium for your child.

the courts determine who is required to provide insurance. custody is not necessary to remain eligible for tricare. HOWEVER:



the SM is NOT required to maintain Prime, He can drop it to Standard and would NOT be liable for the co pays, you would. nor is he required to provide Dental. unless court ordered.



also since medical insurance is being provided he can legally use that to lower his CS payments accordinglyChild's Health Insurance through military father...?I work with a divorced lady who has a son. Her husband is active duty. Her son is under Tricare...and will be until he's 18 (hubby is a career soldier), or until 21(?) if he goes to college.
